These terms of service apply to non-commercial work for private clients only. Anyone interested in hiring me for commercial work must send me an e-mail to discuss individual terms. Before beginning the commission process, please read and understand the information below. This information is subject to change at any time without notice. Any commissions that fall outside of the guidelines below will be priced on an individual basis. For estimates, commission requests, and questions about working with me, feel free to contact me via e-mail at notmerelyart [at] gmail [dot] com .
All commission requests should include the following information. I will take any necessary artistic liberties when presented with incomplete ideas. A loose description with a few images will almost always leave more room for interpretation than a precise, tight concept.
By sending your request and subsequent payment, you agree to all of the following terms.
Payment:
For painted works, I will provide you with 1-4 thumbnail sketches for approval. After one has been chosen, full payment is required before further work commences unless the total cost of the artwork is $100 or over, in which case you have the option to pay the first half after approving a thumbnail, and the second half at any point before the final, un-watermarked image is e-mailed. For sketch commissions, full payment is required before any work begins. You will be sent an invoice after sending out a commission request. I only accept Paypal at this time.
Content:
I reserve the right to refuse a commission for any reason I see fit. I will not draw hateful images, nude/suggestive images of children, or hardcore pornographic/fetish content (artistic nudity is fine).
Workflow:
All major requested changes to the artwork should be made in the thumbnail sketch stage. A am only willing to do five major revisions to colored illustrations (one for sketch commissions) before adding a fee for additional changes. Critiques and redlines are welcome. After the sketch is approved, I will not provide further previews until the image is complete unless requested by the client. Please allow 3-6 weeks from the time I begin your commission before contacting me if I have not gotten in touch with you unless a deadline has been specified.
Minor changes to the image after it's been completed are acceptable (color changes, addition of small accessories/jewelry, etc), but I will not make large edits to the final piece without an additional fee. The full-sized JPEG of the finished image will be sent to you when completed unless you specify another image type, such as PNG. All specifics should be included in the initial request to keep revisions to a minimum.
Communication:
I will not discuss a commission with a client via public forum, instant messenger, or private note. Communications about commissions between clients and myself will be made only through e-mail and the Asana web application to ensure all information and communications are consolidated in one location. When your commission updates are posted through Asana, you will receive an E-mail, and may leave comments about your commission through the web application that I will receive instantly.
Deadlines:
If you have a deadline, you must let me know in your initial request. At this time, I am unable to honor deadlines that are shorter than 2 weeks from the time the you contact me for the commission, so please keep this in mind when sending your request.
Permissions:
I retain commercial rights to the artwork and will post it in my galleries and portfolios. Prints will only be made for portfolio purposes. You retain all rights to your characters and concepts. Artwork will be posted it in my online galleries with the exception of time-sensitive reasons (holidays, birthdays, etc). You are free to repost and use the artwork for any personal means (forum signatures, wallpapers, etc), but artist credit is required. You may not sell, alter, trace, or claim the artwork as your own without my consent.
Refunds and Cancellation:
Commissions cancelled during the sketch stage will be given a 50% refund of what was paid. Commissions cancelled after the sketch has been approved will not be given a refund. Full refunds will only be given in the event that I am unable to start your commission. Unused or rejected artwork may be recycled for personal use.
